Terms of Service for Soulo Agent

Welcome to Soulo Agent, a mobile application provided by PinkPulse Limited ("PinkPulse Limited," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of the Soulo Agent mobile application, related services, and any associated websites or features (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By continuing to use the Service, including clicking "I Agree" or similar on the Signup or Signin screens, you confirm that you are at least 18 years old, capable of entering a legally binding contract, and agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Soulo Agent is an AI-powered mobile application designed to enhance communication and social experiences through artificial intelligence. The Service may include features such as AI-driven interactions, user-generated content, and social networking functionalities, accessible globally.

3. User Accounts

  • Account Creation: To use certain features, you must create an account by providing accurate information during the Signup process. You are responsible for maintaining the confidentiality of your account credentials.
  • Account Security: You agree to notify us immediately at hello@pinkpulse.page if you suspect unauthorized use of your account.
  • Account Termination: We reserve the right to suspend or terminate your account for violations of these Terms or applicable laws.

4. Community Guidelines, Safety, and User Conduct

To ensure Soulo Agent is a safe and respectful platform for all users, you must adhere to the following rules.

4.1. Zero-Tolerance Policy on Child Sexual Abuse and Exploitation (CSAE)

PinkPulse Limited maintains a strict, zero-tolerance policy regarding any and all forms of Child Sexual Abuse and Exploitation (CSAE) on the Soulo Agent application. We are committed to protecting children from harm. Any user content or conduct that depicts, promotes, encourages, or facilitates the sexual abuse or exploitation of children is strictly forbidden and will be treated with the utmost severity.

This includes, but is not limited to:

  • Child Sexual Abuse Material (CSAM): Any visual depiction (including photos, videos, drawings, or computer-generated images) of a minor engaging in sexually explicit conduct.
  • Grooming: The act of befriending and building an emotional connection with a child to lower their inhibitions for the purpose of sexual exploitation.
  • Sextortion: The act of coercing or blackmailing a child into providing sexually explicit material or performing sexual acts.

Violations of this zero-tolerance policy will result in immediate and permanent termination of the user's account without warning. We will report the user and the offending content to law enforcement authorities, including the National Center for Missing & Exploited Children (NCMEC) or other relevant global child protection agencies.

4.2. Prohibited Conduct and Content

You agree not to use the Service to:

  • Engage in illegal, harmful, or abusive activities.
  • Upload or share content that is hateful, threatening, harassing, or incites violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected attributes.
  • Engage in bullying, intimidation, or personal attacks.
  • Upload or share content that violates intellectual property rights, privacy, or applicable laws.
  • Use the Service to develop competing AI models or services.
  • Attempt to reverse-engineer, decompile, or disrupt the Service's functionality.
  • Share sensitive personal data without proper authorization.

5. Reporting Violations and Enforcement

User vigilance is key to maintaining a safe community. If you encounter any user or content that violates these guidelines, especially our policy on CSAE, please report it immediately.

  • How to Report: You can report violations directly through the in-app reporting mechanism provided within the Soulo Agent application. This is the fastest way to bring an issue to our attention. You may also contact our safety team directly at safety@pinkpulse.page.
  • Enforcement: We take all reports seriously. Our team will investigate and may take a range of enforcement actions, including issuing a warning, removing content, or temporarily or permanently suspending the user's account. As stated above, any violation of our zero-tolerance policy on CSAE will result in a permanent ban and a report to law enforcement.

6. User Content

  • Ownership: You retain ownership of content you create or upload ("User Content"). By submitting User Content, you grant PinkPulse Limited a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, store, modify, and display User Content to provide and improve the Service.
  • Content Responsibility: You are responsible for ensuring User Content complies with applicable laws and does not infringe third-party rights.
  • AI Training: Unless you opt out through account settings (where available), we may use anonymized or aggregated User Content to train our AI models to enhance the Service.

7. Intellectual Property

  • Service Ownership: The Service, including its AI algorithms, design, and content (excluding User Content), is owned by PinkPulse Limited and protected by intellectual property laws.
  • Restrictions: You may not copy, modify, distribute, or create derivative works of the Service without our written consent.

8. Privacy

Your use of the Service is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information. Please review it at Privacy Policy.

9. Global Availability

The Service is available globally, but you are responsible for ensuring your use complies with local laws in your jurisdiction. Some features may vary by region due to legal or technical restrictions.

10. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice within the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Termination

  • By You: You may stop using the Service at any time and delete your account.
  • By Us: We may suspend or terminate your access to the Service for violations of these Terms, illegal activities, or at our discretion with notice where feasible.
  • Effect of Termination: Upon termination, your license to use the Service ends, but provisions regarding intellectual property, user content, and indemnification survive.

12. Indemnification

You agree to indemnify and hold PinkPulse Limited, its affiliates, officers, and employees harmless from any claims, losses, or damages arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

13. Limitation of Liability

To the fullest extent permitted by law, PinkPulse Limited is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid (if any) to use the Service in the past 12 months.

14. Governing Law and Dispute Resolution

California law will govern these Terms except for its conflicts of laws principles. Except as provided in the Dispute Resolution section above, all claims arising out of or relating to these Terms will be brought exclusively in the federal or state courts of San Francisco, California.
